Pebble Climbing Privacy Policy

Introduction

This Privacy Policy (“Policy”) explains how Pebble Climbing, LLC (the “Company”, “we” or “us”) collects, uses and shares information about you when you access or use our websites or other online or mobile services or applications (“Services”), or otherwise interact with us. For purposes of this Policy, personal information includes “personal data” and similar terms as defined under applicable privacy laws. Please read this Policy carefully to understand our policies and practices regarding your information. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using our Services, you agree to this Policy.

Unless otherwise indicated, this Policy does not apply to third parties, including products or service providers and other users, or the practices of companies that we do not own or control, including other companies you might interact with on or through the Services, such as climbing gyms, other businesses or people that use our Services.

If we make changes to this Policy, we will notify you of such changes, such as by sending an email, posting a notice on the Services or updating the date at the top of this Policy. Unless we say otherwise, the amended Policy will be effective immediately and your continued use of the Services will confirm your acceptance of the revised Policy. We encourage you to review the Policy whenever you access our Services. If you do not agree to these or any updated Policy, you can delete your account.

Pebble Climbing, LLC is headquartered in Salt Lake City, Utah. If you are a resident of the European Economic Area (“EEA”), Pebble Climbing, LLC is the controller of your personal data for the purposes of EEA data protection law.

Children under the age of 13

Our Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Services. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@pebbleclimbing.com.

The information we collect

We collect information about you, including information that directly or indirectly identifies you, if you or others share it with us. We receive information in a few different ways, including when you post, log, or otherwise upload or record activities and information using the Services. We also collect information about how you use the Services. There are also several opportunities for you to share information about yourself, your friends, and your activities with us. For example:

A. Information you and others provide

Account, Profile, Activity, and Use Information

We collect basic account information such as your name, email address, username and password that helps secure and provide you with access to our Services. We also may collect your gender, age, height and weight, if you choose to add it to your profile.

Profile, activity and use information is collected about you when you choose to upload a climbing area, route, picture, video, link or comment; record a try, send, workout, or other activities or behavior (including date, time, climbing area, climbing gym, and geo-location and other location services information); join a group or challenge; rate or grade a climb; add your gear or its usage; view others’ activities; or otherwise use the Services.

Contacts information

If available, you can choose to add your contacts’ information by connecting your contacts from your mobile device, computer or social networking accounts to the Services. If you choose to share your contacts with us, we will access and store your contacts’ information in order to identify connections and help you connect with them.

Location information

We collect and process location information when you sign up for and use the Services. You can choose whether we track your device location while you are not using the Services, but in order to provide full use of the Services, it may be necessary for us to track your device location at all times. If you would like to stop the device location tracking, you may do so at any time by adjusting your device settings.

Health information

We may collect or infer health information. Certain health information may be inferred from sources such as heart rate, training diagnostics or other measurements, including height, weight or other indicators.

Payment information

When you make a payment on the Services, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information.

Information about or from your climbing gym

The Services allow you to identify, interact and associate with climbing gyms. Those gyms may collect information about you under their own agreement with you, and they may provide us information about you.

Information from your climbing partners, areas and gyms and other users

We may collect information about you from other users such as when they give you fist bumps, take videos or photos of you while climbing together, sharing workouts, comment on your activities, or sync or import your contact information. We may also collect information about you from your climbing gyms, participation in events, and from your use of climbing area guides.

Third-party accounts

The Services allow you to sign up and log in to the Services using accounts you create with third-party products and services, such as Facebook, Google, or Apple (collectively, “Third-Party Accounts”). If you access our Services with Third-Party Accounts we will collect information that you have agreed to make available such as your name, email address, profile information and preferences. This information is collected by the Third-Party Account provider and is provided to us under their privacy policies. You can generally control the information that we receive from these sources using the privacy settings in your Third-Party Account.

Other information

We may collect information from you through third parties, such as when we collect your feedback through surveys.

B. Device Information

Technical information and log files

We collect information from your browser, computer, and mobile device, which provide us with technical information when you access or use the Services. This technical information includes device and network information, cookies, tokens, log files and analytics information.

The Services may use log or other types of files which may contain information that includes IP addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. IP addresses may be linked to session IDs, user IDs and device identifiers.

Connected equipment and apps

When available, we collect information from equipment and apps you connect to the Services. For example, you may connect your Garmin watch or Apple Watch account to the Services and information from these devices and apps will be passed along to us. Similarly, you may be able to connect to other apps from the Services, such as Instagram, and information will be passed along to us.

How we use the information

We use the information we collect and receive to operate and improve the Services and to customize them for you. For example, we may track the types of climbs you like or recommend, particular climbs, areas or gyms you visit, or products you may like. Subject to your privacy setting, your information, including parts of your profile, username, photos, video, users you follow and who follow you, climbing gyms and areas you visit or follow, your activities, the devices you use, and fist bumps and comments you give and receive will be shared on the Services so that you may be able to participate in the use of the Services. Subject to your privacy settings, this information may also be shared with climbing gyms you follow or visit. Certain information (e.g., your name or other profile information) is also available to the public on the web. Your precise location information, such as your sends, climbs, home, or visited gyms and gym areas, may also be shared on the Services, to climbing gyms, or to non-users, in accordance with your privacy settings.

We use the information we collect about you, your followers, your climbing gyms and areas, and your activities to customize your experience. For example, we may suggest climbs, climbing areas and gyms, beta, or products that may interest you, or athletes that you may want to follow. We also use the information we collect to process payments, provide support related to the Services, protect users and enforce our Terms of Use, promote safety, and to communicate with you (including to send marketing and push communications) where you have not opted out of receiving such messages and notifications.

We use the information we collect to analyze, develop and improve the Services. To do this, we may use third-party analytics providers to gain insights into how our Services are used and to help us improve the Services.

Technical information and log files may be used to analyze trends, administer, protect and secure the Services, track user movement, and gather broad demographic information for aggregate use.

We may also use the information we collect to market and promote the Services, activities on the Services, and other commercial products or services. This includes customizing your user experience. For example, if we know that you like boulder problems, we may tell you about new problems or bouldering areas or show you sponsored content related to bouldering. If we see that you climb in a certain area, we may suggest a climbing competition in that area.

We use your contact information so we can respond to your support requests and comments, and to provide you updates on the Services, these Terms and our Privacy Policy.

We do not sell your personal information, although we may share identifying and other information with third parties for you to use certain Services. Subject to your privacy settings, we may provide your identifying information and other Service use information to climbing gyms and other third parties in order for you to use certain Services, such as climbing competitions, other event participation, rewards programs, and climbing gym registrations and other features. We may also remove personally identifiable information or aggregate the information you and others make available in connection with the Services and post it publicly or share it with third parties. Examples of the type of information we may aggregate include information about equipment, usage, participation, demographics, routes and performance. We may use, sell, license, and share this aggregated information with third parties for research, business or other purposes. We also use aggregated data to generate recommendations and to communicate with users.

How the information is shared

In addition to sharing aggregated or de-personalized data about our users as described above, we also share your information to provide the Services, run our business, and where required for legal purposes, as set forth below.

Service providers

We may share your information with third parties who provide services to us such as supporting, improving, promoting and securing the Services, processing payments, or otherwise providing goods or services to us. These service providers only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information. We may also engage service providers to collect information about your use of the Services over time on our behalf so that we or they may promote the Services or display information that may be relevant to your interests on the Services or other websites or services.

Publicly available information

When you create an account on the Services, your profile and your activities are set to be publicly viewable by default. Your name and other profile information are viewable by other users of our Services and the public and, subject to your privacy settings, additional information and content you share may also be publicly viewable. For example, your sends and other activities may be accessed by other users and or viewable on publicly accessible Services. We provide you the option of making your account public or private to control the sharing of certain information, such as your sends tab and profile information.

Sharing information and activities with other users, the public, and climbing gyms

As a social network and a platform to connect you to climbing gyms, we share your information with other users, climbing gyms, and the public in accordance with your privacy setting. You can change the visibility of the activities you upload to the Services and indicate participation (e.g., by opting in or out) in features that require sharing of your information with climbing gyms and other third parties. Certain features of the Services enable you to connect to climbing gyms, which may require us to share your identifying information and other Service use information with climbing gyms and other third parties. You can also share your activities with your contacts via text, email, or on social media applications like Facebook, Instagram, and Twitter. If you link your account to other social networks and share your activities, they will be viewable on such third-party platforms, including your location information. You should use caution when sharing information via third parties and you should carefully review the privacy practices of such third parties.

Third party businesses via API or other integrations

When the Services are integrated with third party apps, plugins, or websites, as well as with third parties who work with us to offer an integrated feature, we enable you to share your information. If you click on the link for a sponsored integration, you will leave our platform and the sponsor may be able to identify that you visited their platform from the Services. Information collected by these third parties is subject to their terms and policies. We are not responsible for the terms or policies of third parties.

Affiliates and acquirers of our business or assets

We may share your information with affiliates who are required to comply with the terms of this Policy with regard to your information. If we become involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such transaction.

Legal requirements

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your state or country of residence, if we determine that such disclosure is allowed by the law or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that this is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Use or fraud or abuse of our Services or users, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

DMCA notices

We may share your information with third parties when we forward Digital Millennium Copyright Act (DMCA) notifications, which will be forwarded as submitted to us without any deletions.

How we protect information

We take several measures to safeguard the collection, transmission and storage of the data we collect. We employ reasonable protections for your information that are appropriate to its sensitivity. The Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of personal information and credit card numbers. The Services are registered with site identification authorities so that your browser can confirm our identity before any personal information is sent.

Choices regarding how information is used or shared

Privacy settings

We provide you the option to make your activities private. Once you select your account to be private, only people you have approved to follow you can see your sends tab and profile information. Media, comments, guidebook input, gym affiliations, and tags, that are not in your sends tab will remain publicly viewable. Your profile picture is always publicly viewable.Your privacy settings may also include allowing you to opt in or out of sharing your information with other third parties, such as climbing gyms, although opting out may limit your use and access of certain parts of the Services.

Adjust notification and email preferences

We offer various ways to manage the notifications you receive. You may unsubscribe by following the instructions contained at the bottom of each email and stop receiving notifications through your device settings functionality. Any administrative or service-related emails (to confirm a purchase, or an update to this Policy or our Terms of Use, etc.) generally do not offer an option to unsubscribe as they are necessary to provide the Services you requested.

Your legal rights in the EEA

If you are habitually located in the EEA, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information.

Transfers

The Services are operated from the United States. If you are located outside of the United States and choose to use the Services or provide information to us, you acknowledge and understand that your information will be transferred, processed and stored in the United States, as it is necessary to provide the Services and perform theTerms of Use. United States privacy laws may not be as protective as those in your jurisdiction.

Access, removal, and retention of information

Updating account information

You may correct, amend or update profile or account information at any time by adjusting that information in your profile/account settings. If you need further assistance correcting inaccurate information, please contact us at support@pebbleclimbing.com.

Deletion and retention of information and accounts

You can delete your account. To delete your account, log in and edit your account, which provides the option to delete. After you delete your account, your account, your profile, photos, videos, comments, fist bumps and your follower relationships will be permanently removed. In addition, you can delete some items of information (e.g., profile information) and you can remove individual activities from view on the Services without deleting your account. Content you delete may persist for a limited period of time in backup copies and will still be visible where others have shared it. Once deleted, your data, including your account and activities cannot be reinstated. Following your deletion of your account, it may take up to 90 days to delete your personal information and system logs from our systems.

We may retain information where deletion requests are made to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms of Use and take other actions permitted by law. The information we retain will be handled in accordance with this Policy. We may also retain information that is de-identified to you or aggregated with other non-personal data to provide insights which are commercially valuable to us, such as statistics of the use of the Services. For example, we may retain publicly available guides, gym data, and depersonalized geolocation information to continue to improve the Services. This information will be de-associated with your name and other identifiers.

Note that information that has been shared with third parties, such as climbing gyms, may be retained by those third parties according to their policies. Further, content you have shared with others, such as climbs, climbing areas, photos or videos, or that others have copied may also remain visible after you have deleted your account or deleted specific information from your own profile. Your public profile may be displayed in search engine results until the search engine refreshes its cache

We also provide you the option to remove individual activities you have posted from view on the Services without deleting your account. The deleted activities, however, will typically remain on our backup systems.

Retention of information

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted. In addition, you can delete some items of information (e.g., profile information) and you can remove individual activities from view on the Services without deleting your account. Following your deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems.
